2. Applicability
By using our website and/or services, you accept these terms and conditions. Deviations are only valid if agreed upon in writing.
These terms have been drafted in accordance with the Belgian Civil Code (Book 6), the Belgian Code of Economic Law (Book VI on Market Practices and Consumer Protection), and European consumer protection regulations.
3. Quotations and agreements
All quotations are non-binding and valid for 30 days, unless stated otherwise. An agreement is concluded when the client accepts a quotation in writing (by email or signature).
Prices are exclusive of VAT, unless explicitly stated otherwise. Wallvision reserves the right to adjust prices in case of changed circumstances, such as material costs or altered project scope.
4. Execution of services
Wallvision commits to executing the agreed services to the best of its ability and in accordance with professional standards. Stated execution periods are indicative and non-binding, unless explicitly agreed otherwise.
The client ensures that the walls to be printed are clean, dry and accessible at the agreed time. Any additional costs due to unforeseen circumstances (such as unsuitable wall surfaces) will be discussed with the client in advance.
5. Payment
The invoice is issued after completion of the project.
Invoices are payable within 14 days of the invoice date. In case of late payment, interest is due by operation of law in accordance with the Belgian Late Payment Act (Law of 2 August 2002), as well as a fixed compensation of 10% of the invoice amount with a minimum of €50.
6. Right of withdrawal (consumers)
In accordance with Article VI.47 of the Code of Economic Law, the consumer has a withdrawal period of 14 calendar days after the conclusion of the agreement, unless the service has already been fully performed with the express prior consent of the consumer and their acknowledgement that the right of withdrawal is thereby forfeited.
The right of withdrawal does not apply to custom-made products manufactured specifically according to the client's specifications (Article VI.53, 3° CEL).
7. Intellectual property
All designs, concepts and files created by Wallvision remain the property of Wallvision, unless agreed otherwise in writing. The client obtains a non-exclusive right of use for the agreed purpose.
When the client provides their own image material, the client guarantees that they hold the necessary rights and indemnifies Wallvision against claims from third parties.
8. Liability
Wallvision is only liable for direct damage resulting from a proven shortcoming in the execution of the agreement. Liability is limited to the invoice amount of the relevant project.
Wallvision is not liable for indirect damage, consequential damage, lost profits or damage to the wall surface resulting from the existing condition of the wall.
9. Warranty
Wallvision guarantees the quality of the delivered work. Complaints must be reported in writing within 7 working days after completion. After this period, the work is deemed accepted.
The warranty lapses in case of damage caused by external factors such as moisture, mechanical damage, or modifications made by third parties.
10. Force majeure
In case of force majeure (including but not limited to extreme weather conditions, pandemic, strikes, supply problems), Wallvision is not obliged to fulfil any obligation. Both parties may dissolve the agreement if the force majeure lasts longer than 60 days.
11. Privacy
Wallvision processes personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian privacy legislation. More information can be found in our privacy policy and cookie policy.
12. Dispute resolution
Belgian law applies to these terms and conditions. In case of disputes, only the courts of the judicial district where Wallvision is established have jurisdiction.
Consumers can turn free of charge to the Belgian Consumer Mediation Service, Vooruitgangstraat 50, 1210 Brussels (https://consumentenombudsdienst.be). The European ODR platform has been discontinued and is no longer an alternative.
